HYSTOU Terms and Conditions
Chapter 1: General Provisions
Article 1: Agreement Validity
By accessing, registering, or using hystou.com (the “Website”), you are deemed to have fully read and agreed to be bound by these Terms, the Privacy Policy, and related documents. If you disagree with any terms, immediately cease using the Website.
Article 2: User Eligibility
- Only individuals aged 18 or above with full civil capacity, or legally established organizations, may register an account.
- Minors Clause:
- Users under 14 years old are prohibited from registering or submitting personal information;
- Users aged 14 to 18 must obtain written consent from a legal guardian (submitted via official form or notarized document) to use the Website.
Chapter 2: Intellectual Property
Article 3: Ownership
- All content on the Website (including text, images, code, trademarks) is owned by HYSTOU or its licensors, protected under the Copyright Law, Trademark Law, and international conventions.
- Infringement Claims: Rights holders may submit written notices to sales@hystou.com. HYSTOU will take necessary actions within 15 business days upon valid notification.
Chapter 3: User Conduct
Article 4: Prohibited Activities
Users shall not:
- Upload viruses, malware, or content that harms network security;
- Post illegal content (e.g., obscenity, terrorism, discrimination) under Chinese or local laws;
- Use automated tools (e.g., crawlers) to collect data without authorization. Excessive daily access (e.g., causing server overload) will be deemed unlawful;
- Engage in fraudulent transactions, money laundering, or illegal activities.
Article 5: Content Moderation
HYSTOU will review user-generated content per the Cybersecurity Law and remove illegal information promptly.
Chapter 4: Account and Data Security
Article 6: Account Responsibility
- Users must safeguard account credentials. All operations are deemed user-authorized.
- Report suspicious activity to sales@hystou.com immediately; otherwise, users bear resulting losses.
Article 7: Cross-Border Data Transfer
- Users agree that the following data may be transferred overseas under the Data Export Security Assessment Measures:
- Order information (recipient name, address);
- Payment verification data (necessary for cross-border settlement);
- Other legally required scenarios.
- Transfers will comply with standard contracts approved by Chinese authorities or user consent. Details are in the Data Cross-Border Statement.
Chapter 5: Liability Limitations
Article 8: Exemptions
HYSTOU is not liable for:
- Service interruptions due to force majeure (e.g., natural disasters, cyberattacks), provided users are notified within 48 hours;
- Losses caused by users sharing account credentials;
- Disputes arising from third-party links or ads.
Article 9: Liability Cap
Users liable for breaches shall compensate HYSTOU up to 200% of the transaction value or actual losses (whichever is higher).
Chapter 6: Governing Law and Dispute Resolution
Article 10: Governing Law
- These Terms are governed by Chinese law.
- Data cross-border clauses follow the Personal Information Protection Law and the Data Security Law.
- Consumer disputes apply the law of the user’s habitual residence.
Article 11: Dispute Resolution
- Disputes shall first be resolved through negotiation.;
- If unresolved, submit tothe Hong Kong International Arbitration Centre (HKIAC) in Chinese.
- Consumers may sue in Mainland Chinese courts (place of performance or defendant’s domicile).
Chapter 7: Miscellaneous
Article 12: Amendments
HYSTOU reserves the right to modify these Terms. Major changes (e.g., expanded data exports) will be notified 30 days in advance via Website notice or email. Continued use constitutes acceptance.
Article 13: Termination
HYSTOU may terminate services if:
- Users are inactive for 12 consecutive months with no pending orders;
- Users damage HYSTOU’s reputation (e.g., false reviews, defamation);
- Required by regulatory authorities.
